Welcome to OpenServiceConsortium ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at openserviceconsortium.sbs (the "Service") operated by OpenServiceConsortium.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
OpenServiceConsortium offers luxury yacht charter services, including but not limited to:
- Daylong yacht rentals
- Evening cruises
- Business retreats
- Exclusive gatherings
- Extended yacht charters
All services are dependent on availability and subject to weather conditions. We hold the right to adjust or cease services at our discretion.
3. Booking and Reservations
3.1 Booking Process
For charter reservations, you must:
- Be of minimum 18 years of age
- Supply valid and comprehensive information
- Remit the necessary advance payment as indicated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Booking becomes firm only after we have received the payment and issued a written confirmation. We can refuse services to any individual, subject to our choice.
3.3 Availability
All charter bookings are contingent on the yacht's availability and favorable weather conditions. We will endeavor to honor your requested schedule whenever possible.
4. Payment Terms
4.1 Pricing
All quoted rates are in € and incorporate any relevant taxes unless otherwise specified. Prices can alter with no prior announcement.
4.2 Payment Schedule
- Initial Deposit: 50% of the total cost of the charter at the time of reservation
- Final payment: Must be settled 48 hours prior to the charter's departure
- Other charges (as applicable): Due after the charter concludes
4.3 Payment Methods
We receive payments through major credit cards, electronic bank transfers, and certified bank drafts. For security, payment is processed via encrypted gateways.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full refund less transaction fees
- Between 24-72 hours before departure: Refunded at 50%
- Under 24 hours before departure: No refund available
5.2 Weather Cancellations
In cases of unsafe weather conditions as determined by the captain, we will propose to:
- Reschedule your booking to the soonest open date at no extra cost
- Issue a complete refund if rescheduling is not feasible
5.3 Mechanical Issues
If there's a mechanical issue with the vessel you're assigned, we will aim to arrange a comparable alternative. If this isn't possible, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are expected to:
- Heed all directions from the crew
- Utilize designated safety gear when mandated
- Disclose any health conditions that could impact their security
- Stay in assigned zones on the yacht
6.2 Prohibited Items
Certain items are forbidden onboard:
- Items made of glass
- Unlawful substances
- Guns or other weaponry
- Over consumption of beverages
- Pets, except if agreed upon in advance
6.3 Conduct
Guests should behave respectfully at all times. We have the right to cease the charter immediately without a refund if a passenger's behavior is dangerous or disrupts the event.
7. Liability and Insurance
7.1 Our Liability
We limit our accountability to the expense paid for your charter. We will not be liable for:
- Injuries resulting from your own negligence
- Theft or destruction of personal belongings
- Indirect or punitive damages
- Delays driven by weather or situations outside our control
7.2 Insurance Coverage
Our vessels and operations are covered by full marine insurance. You are responsible for obtaining your personal travel and belongings insurance.
7.3 Assumption of Risk
By participating in our yacht services, you recognize the inherent hazards of marine pursuits and you take on the responsibility for your own safety.
8. Modifications and Itinerary Changes
Our company retains the right to switch itineraries, travel paths, or timetables based on climate considerations, safety needs, or operational mandates. We will make every effort to arrange alternatives of comparable quality.
9. Force Majeure
We bear no responsibility for interruptions, cancellations, or alterations due to factors beyond our control, including but not restricted to:
- Extreme weather phenomena
- Natural calamities
- Governmental ordinances
- Port closures
- Vehicular malfunctions
10. Privacy and Data Protection
Your personal details are managed in line with our Privacy Policy. By utilizing our services, you consent to the gathering and application of your data as outlined in our Privacy Policy.
11. Intellectual Property
All content presented on our website, encompassing texts, visuals, logos, and images, is legally protected. Reproduction, distribution, or the creation of derivative works is prohibited without our express consent.
12. Governing Law
These Terms are subject to the laws of Monaco. Any disputes shall be resolved within the courts situated in Monaco, Monaco.
13. Changes to Terms
We reserve the authority to modify these Terms whenever necessary. Amendments will be indicated on our website, featuring the date of the latest revision. Continual use of our services signifies agreement with the updated terms.
